1. Acceptance of These Terms
By accessing or using Callie Care's website, app, phone, or text-message services (via Message function or any other app providing messaging or calling services, e.g. WhatsApp) ("Services"), you agree to these Terms of Use ("Terms") and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old and legally able to enter into contracts in your state.
2. What Callie Care Does
Callie Care is an AI-powered voice and text companion designed to help older adults stay connected, reduce loneliness, and support families with wellbeing trends and check-ins.
We are not a medical, emergency, or crisis service. We do not diagnose medical conditions or provide medical care, and our wellbeing insights should not be used as a substitute for professional medical advice, diagnosis, or treatment.
If our system detects language or speech patterns suggesting potential distress or confusion, we may notify the caregiver or family member you have authorized. We do not contact 911 or emergency responders.
2.1 Concierge Transportation Service
As part of the subscription, Callie Care may offer a concierge service that assists users in arranging third-party transportation services (such as ride-hailing providers) on behalf of the user. This concierge assistance is included in the monthly subscription fee. Any transportation services arranged through third-party providers, including but not limited to Uber or Lyft, will be charged separately and added on top of the subscription fee. By using this service, the user authorizes Callie Care to request transportation on their behalf.
All transportation services are provided by independent third-party providers, and Callie Care is not responsible for the performance, availability, safety, or quality of such services. Cancellation and refund policies for transportation services are governed solely by the applicable third-party provider. Reimbursements for cancelled rides will only be issued where such reimbursement is provided by the respective transportation provider under their applicable terms and conditions.
If a specific transport is required, the User shall inform Callie Care in advance.
3. Your Account
- Provide accurate and complete information when creating your account
- Keep your account information updated
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity under your account
You may not impersonate any person or provide false information.
4. Subscriptions & Payments
Plans include a 7-day free trial. After the trial, pricing is:
- Weekly plan: $8.95/week
- Monthly plan: $33.95/month
- Quarterly plan: $89.95 for 3 months
Subscriptions auto-renew until cancelled.
You may cancel at any time during or after your trial through your account settings or by emailing support@getcallie.care.
Fees are non-refundable except as required by law or within your trial period before billing begins. Trial users are not charged until day 8. You may cancel anytime before then to avoid charges.
5. Use of the Services
- Misuse, copy, reverse-engineer, or resell the Service
- Use the Service to send spam, threats, or unlawful content
- Record or share Callie Care's AI voice or output without consent
- Provide false or misleading information
- Attempt to bypass service controls or security measures
If you provide caregiver contact information, you confirm you have permission to do so.
6. Consent to Recordings, AI Processing & Communications
6.1 Recorded Calls and Messages
Callie Care records calls, creates transcripts, and may generate AI-based analysis (e.g., tone, sentiment, speech patterns) for the purpose of:
- Delivering conversations
- Personalizing interactions
- Detecting wellbeing cues
- Notifying caregivers you designate
You agree that Callie Care may store these recordings and transcripts in accordance with our Privacy Policy.
6.2 Automated and AI-Enhanced Processing
You acknowledge and consent to automated processing of your data, including generating wellbeing insights and detecting potential indicators of distress, confusion, or emotional change.
6.3 Communications Consent
By using the Services, you agree to receive phone calls, text messages, WhatsApp messages, and automated communications from Callie Care at the number you provide. Standard carrier rates may apply. You may opt out of marketing messages at any time.
7. Health and Safety Disclaimer
- Are for informational purposes only
- Are not medical advice
- Should not be used to make health decisions
- Should not replace consultation with a qualified healthcare professional
If you feel unwell, unsafe, or in an emergency, call 911 or seek professional help immediately.
8. Intellectual Property
All software, AI voices, conversational content, designs, and other materials provided through the Services are the property of Callie Care Inc. You may not copy, reproduce, distribute, or create derivative works without our written permission.
9. Termination
- You violate these Terms
- You misuse or attempt to interfere with the Services
- We reasonably believe your continued use may cause harm
You may stop using the Services at any time by cancelling your subscription.
10. Limitation of Liability
To the fullest extent permitted by law:
Callie Care and its officers, employees, and agents are not liable for any indirect, incidental, special, or consequential damages. This includes damages related to emotional distress, missed alerts, wellbeing insights, or harm (including self-harm or suicide) unless caused by our gross negligence or intentional misconduct.
Our total liability to you will not exceed:
- $100, or
- The amount you paid in the past 12 months,
whichever is greater.
11. User Rights & Privacy
Your use of the Services is also governed by our Privacy Policy, which explains:
- What information we collect
- How we use, store, and share it
- Your rights under applicable U.S. privacy laws
- How to request access, correction, or deletion of your information
By using the Services, you acknowledge that you have reviewed and agree to the Privacy Policy.
12. Dispute Resolution & Arbitration
Most issues can be resolved by contacting support@getcallie.care.
If we cannot resolve a dispute informally, you and Callie Care agree to binding arbitration on an individual basis under the rules of the American Arbitration Association (AAA). There will be no class actions or jury trials unless you opt out.
You may opt out of arbitration within 30 days of accepting these Terms by emailing support@getcallie.care with the subject line: "Opt out of arbitration."
13. Governing Law
These Terms are governed by the laws of the State of Delaware. Any disputes not subject to arbitration will be heard exclusively in state or federal courts located in Wilmington, Delaware.
14. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page shows the most recent version. Continued use of the Services after changes take effect means you accept the updated Terms.
